6. SUPPLIER DECLARATION. RECOMMENDATIONS.

 

6.1 I&G CALIMPEX GmbH meets all the requirements of German and EU law in relation to food supplements, the requirements for issuing the certificate of exemption and all statutory and official regulations in the field of e-commerce, distance selling and off-premises sales in relation to the offer and sale of the specific products offered by I&G CALIMPEX GmbH via its e-shop.

 

6.2. All products offered in the online shop are NOT intended to cure or treat medical diseases and conditions.

 

6.3. All products offered on the website https://www.igcalimpex.comне are not medicinal products and should not be used as such in any way. Neither the website nor I&G CALIMPEX GmbH as a supplier can be held liable in any way for the use of the products as medicinal products.

 

6.4. It is recommended to consult the personal doctor or specialist before taking the products.

 

6.5 Pregnant women, nursing mothers and children under the age of 18 are recommended to consult their personal doctor or specialist before using the products offered by I&G CALIMPEX GmbH.

6.9 I&G CALIMPEX GmbH supplies its customers with goods from the field of sports and health nutrition, i.e. with food supplements.

 

6.10.1 I&G CALIMPEX GmbH observes the financial laws of the Federal Republic of Germany and undertakes to issue a receipt for the value of the ordered products in the case of cash sales.

 

6.10.2. If a receipt is missing for a sent order, the user can also request one

6.11. If the user is a legal entity and expressly requests a tax invoice to be issued when placing the order, I&G CALIMPEX GmbH is obliged to issue an original primary invoice document upon delivery of the goods/product.

The products made available on the website are manufactured in the EU, registered in the EU and Germany and comply with the EU regulations on distance selling of food supplements - Regulation No. 1169/2011. The subject of sale is any product that can be purchased by a customer. The order assumes the customer's express approval of the quality and appearance of the product.

9. ORDERS

All orders are subject to acceptance and availability. Orders placed by you will be treated as an offer to purchase the goods or services from us and we may refuse any such offer at any time. You acknowledge that any automated acknowledgment of receipt of your order that you may receive from us does not mean that we accept your offer to purchase goods or services advertised on our website. The formation of a contract between you and us will take place when we (i) charge your credit or debit card or PayPal account, or (ii) dispatch the goods to you or start providing the services (whichever is later) . You are responsible for the goods being delivered to the address you provided at the time of ordering. We accept no liability if you enter an incorrect delivery address or if you fail to collect the goods from the delivery address you have provided.

Notwithstanding the fact that risk of loss of or damage to the Products does not pass to you until they have been delivered to the delivery address, title to the Products will pass to you if the following event occurs: (a) the Products from us to be shipped; and (b) we receive payment for the Products.

10. RIGHT OF WITHDRAWAL

If you bought the goods or services as a consumer (ie for private use as opposed to commercial use), you have the right to cancel any contract you have with us within 14 days of receipt of the goods ('cooling off period').

If you terminate a contract within the cancellation period, please read our general terms and conditions on the right of return.

11. PRICE AND PAYMENT

All prices displayed on the website are inclusive of VAT (where applicable) at the applicable rate and are correct at the time the information is entered into the system. If we discover an error in the price of any goods you have ordered, we will let you know as soon as possible and give you the option of reconfirming your order at the correct price or canceling it. 13. CANCELLATION OF DELIVERY OF GOODS

If you fail to comply with these Terms, we will only be liable to you for losses you suffer as a result of our failure (whether in contract, tort [including negligence], breach of statutory duty or otherwise) which are a foreseeable result of such failure.

(b) Our liability for the following is in no way excluded or limited by the content of these GTC:

(i) death or personal injury caused by our negligence;

(ii) fraud or fraudulent misrepresentation;

What types of personal data our company collects, processes and stores

Article 3 (1)The company carries out the following operations with the personal data you provide for the following purposes:

- Registration of a user online-Shop and conclusion of a distance contract - the purpose of this operation is to use the online store to purchase goods and provide contact details for the delivery of the purchased goods.

Impact assessment conclusion:Based on the impact assessment conducted, performing the process "registering a user in the online store and concluding a distance contract" is acceptable and provides sufficient guarantees for the protection of the rights and legitimate interests of the data subjects in accordance with the requirements of the General Data Protection Regulation.

- Concluding and executing a commercial transaction with a customer or partner- The purpose of this process is the conclusion and execution of a contract with a trading partner or customer and its administration. Given the limited scope of the personal data collected and the fact that some of this data comes from publicly available sources, it is not necessary to carry out an impact assessment for this operation.

- Sending additional information- This process is used to manage the process of sending information to customers who have indicated that they wish to receive it. Given the limited scope of the personal data collected, an impact assessment of the process is not required.

- Exercising the right of refusal or complaint- the purpose of this operation is to manage the process of exercising the right of refusal or complaint by the customer. Art. 4 (1) The Company performs the following operations with the personal data provided by you as a legal representative or agent of a legal entity - a business partner, for the following purposes

- Conclusion and execution of a commercial transaction: For the conclusion and execution of a commercial transaction with a trading company, we process the full name, telephone number and e-mail address of the legal representative or the person authorized by the company.

Impact assessment conclusion:Given the small number of individuals whose data is processed and the limited amount of personal data collected, it is not necessary to carry out an impact assessment for this operation.

(2) The personal data are collected by the data controller from the persons to whom they refer and from the commercial agency when registering the company.

(3) The company does not carry out automated decision-making with data.

Article 5. The administrator uses so-called cookies to ensure the full functionality of the website, to improve user experience, for statistical purposes, to facilitate access, etc., to which you agree by using our website. You can control and/or delete cookies at any time via the settings of the browser you are using. "Cookies do not constitute personal data and are not used to identify visitors and users of the e-shop.

 

Duration of storage of your personal data

Article 6 (1)The data controller will store your personal data for a period no longer than the duration of the order made by that user (see paragraph 3 below). After your deletion as a user, the data controller will take the necessary care to immediately delete and destroy all your data or make them anonymous (i.e. put them in a form that does not reveal your identity).

Art. 8 (1) The controller may, at its own discretion, transfer some or all of your personal data to processors in order to fulfill the processing purposes to which you have consented, subject to the requirements of Regulation (EU) 2016/679 (GDPR) .

(2) The controller will inform you if he intends to transfer some or all of your personal data to third countries or international organizations.

Article 12 (1)You have the right to ask the administrator to delete some or all of your personal data, and the administrator is obliged to delete such data without undue delay if one of the following reasons applies:

- the personal data are no longer necessary for the purposes for which they were collected or otherwise processed;

- you withdraw your consent on which the processing is based and there is no other legal basis for the processing;

- you object to the processing of your personal data, including for direct marketing purposes, and there are no overriding legitimate grounds for the processing;

- the personal data have been processed unlawfully;

- the personal data must be erased for compliance with a legal obligation under EU or Member State law to which the controller is subject;

- the personal data were collected in connection with the provision of information society services.

(2)The controller is not obliged to erase the personal data when storing and processing them:

- to exercise the right to freedom of expression and the right to information;

- to fulfill a legal obligation that requires processing under EU or Member State law applicable to the controller, or to perform a task that is in the public interest or in the exercise of official authority that is responsible for the processing has been delegated to those responsible;

REFUSED ORDERS, COMPLAINTS AND RETURNS

The user can cancel his order before it is prepared for delivery by courier or delivered to the address specified by the user - by written notice toigcalimpex@gmail.comor by telephone contact.

The user has the right to check the content of his order before accepting it from the courier company.

The user has the right to return the received goods within 14 working days after receipt without compensation and without giving any reason.

In this case, the user must return the goods in their original packaging, intact and unused.

If these conditions are not met, I&G CALIMPEX GmbH reserves the right to refuse to accept the returned goods and accordingly not to fully refund the amount paid by the user.

The user is obliged to notify I&G CALIMPEX GmbH of their return request in writing to the e-mail addressigcalimpex@gmail.comand send it back to I&G CALIMPEX GmbH, with the costs of the return being borne by the user.

In the event of the return of a product already delivered and compliance with the conditions of integrity of the packaging and non-use of the goods, theI&G CALIMPEX GmbHwithin the statutory period of 30 days, the amount of the value of the product(s) using the means of payment used to pay for the order. All costs incurred by the user for the receipt and return of the purchased goods, bank charges and other costs that exceed the value of the products of the order are borne by the user.
